Terms of Service
This is a reference translation of the Korean original. If the two differ in meaning, the Korean version prevails.
Article 1 (Purpose)
These Terms set out the conditions and procedures for using the mobile application Damu (the "Service") provided by Damu (the "Operator"), and the rights and obligations of the Operator and the user.
Article 2 (Definitions)
- "Service" means the application that lets a user generate and keep a card-shaped image based on a photo they select and a record they write.
- "Card" means the image the Service generates and stores on the user's device, together with the record attached to it.
- "User" means a person who uses the Service under these Terms.
Article 3 (Effect and amendment of these Terms)
- These Terms take effect when posted on the Service screen or on the Operator's website.
- The Operator may amend these Terms within the limits of applicable law, and will give notice from 7 days before any amendment takes effect. Amendments unfavourable to users will be announced 30 days in advance.
- A user who does not agree to amended Terms may stop using the Service and delete the App.
Article 4 (Contents of the Service)
The Operator provides the following functions.
- Creating a card from a photo and a record
- Keeping, viewing, and searching generated cards and records on the device
- On-device notifications and a biometric lock
- Saving and sharing card images
Article 5 (Formation of the contract and fees)
- The contract of use is formed when you install the App and begin using it; no separate sign-up is required.
- The Service is currently provided free of charge. If paid features are introduced in future, notice will be given 30 days in advance, and features already provided free of charge will not be made paid retroactively.
Article 6 (User obligations)
A user must not do the following.
- Upload photos that infringe another person's portrait rights, copyright, or other rights
- Enter content that violates the law or damages another person's reputation
- Exploit vulnerabilities in the Service or generate an abnormal volume of requests by automated means
- Reverse-engineer the Service or reproduce or distribute it without authorisation
Article 7 (Rights in content)
- Rights in the photos and records a user enters belong to the user. The Operator does not use them for any purpose other than creating cards, and does not use them to train artificial intelligence models.
- A user may freely use the card images generated by the Service for personal or commercial purposes.
- Rights in the Service's trademarks, logo, design, and software belong to the Operator.
Article 8 (Nature of AI-generated output)
- Cards are generated by an artificial intelligence model, so the same photo and record may produce a different result each time.
- The result may differ from a user's expectations, and the Operator does not guarantee any particular form or quality of output.
- Even when generation fails, the photo and record a user entered are preserved on the device as they were, and can be tried again.
Article 9 (Data storage and the user's responsibility)
The Service does not keep a user's cards or records on any server. All data is stored only on the user's device.
- Accordingly, if data is lost through loss, failure, or reset of the device, deletion of the App, or a deletion the user performs, the Operator cannot recover it.
- A user should, where necessary, keep their own copies by using the device's backup feature or by saving cards to the Photos app.
- The Operator bears no obligation to back up user data.
Article 10 (Changes to and suspension of the Service)
- The Operator may change the contents of the Service or suspend its provision, with notice given in advance. Where there is an urgent reason, notice may be given afterwards.
- The Service depends on artificial intelligence services provided by third parties, so a failure or policy change at those providers may make card creation temporarily or permanently unavailable.
Article 11 (Limitation of liability)
- The Operator is not liable for damage arising from causes beyond its control, such as acts of God, network failures, or failures of external services.
- The Operator is not liable for the lawfulness or accuracy of the content a user enters into the Service.
- This Article does not apply to damage caused by the Operator's wilful misconduct or gross negligence.
Article 12 (Governing law and jurisdiction)
- These Terms are interpreted under the laws of the Republic of Korea.
- Disputes concerning use of the Service are brought before the court having jurisdiction under the Civil Procedure Act.
